Understanding the Purpose of a Coroners Seal

Imagine a scenario where a mysterious death has occurred, and authorities are called to the scene. In such cases, the coroner plays a crucial role in determining the cause of death. The Authority of Coroners

According to California Code, Government Code – GOV § 27491.3, the coroner is empowered to safeguard and secure the personal effects, valuables, and property of the deceased, whether they are found at the scene of death or are related to the inquiry. This ensures that these items are protected until proper legal actions can be taken.

Securing the Premises

To prevent unauthorized access to the premises, the coroner has the right to lock the door or doors and apply a seal. This seal prohibits entrance to the premises until a legally authorized representative of the deceased arrives. It is important to note that this action should not interfere with any ongoing investigations being conducted by other law enforcement agencies.

If the property of the deceased remains on the premises while it is locked or sealed, any costs incurred may be charged against the deceased’s estate. It is illegal for anyone to tamper with or remove the seal or locks without express permission from the coroner. Violation of this section is considered a misdemeanor.

Criminal Investigations

In cases where the death is suspected to be criminal in nature, any property or evidence related to the investigation may be handed over to a law enforcement agency or district attorney, with the coroner’s knowledge. Respect for the Deceased

To maintain the integrity of the investigation, it is essential to respect the deceased. No person should search for or remove any papers, money, valuable property, or weapons from the person or premises of the deceased before the coroner’s arrival or without the coroner’s permission. Doing so is considered a misdemeanor.

Upon arriving at the scene, the coroner carefully assesses the situation. If there are indications of a potential police investigation or criminal prosecution, the body and related evidence should not be further disturbed until the arrival of law enforcement officials. The custody and control of the body remain with the coroner, and ample time is given for other law enforcement agencies to conduct their criminal investigations.

Anatomical Donor Cards

In cases of death due to a traffic accident, a peace officer is authorized to search the deceased’s person or property to find a driver’s license or identification card. The purpose of this search is to determine if an anatomical donor card is attached. If such a card is found, indicating the deceased’s status as an anatomical donor, the peace officer must immediately inform the coroner who has jurisdiction.
