Why “Federal Limits Apply” on Your Driver’s License?

Have you ever noticed the phrase “FEDERAL LIMITS APPLY” on your California driver’s license? You might wonder what it means and if it affects your ability to use it as an identification document.

Understanding the Notation

Well, here’s the scoop: a driver’s license with the “Federal Limits Apply” notation means that it does not meet the federal standards required by the REAL ID Act for a compliant card. However, don’t worry, it doesn’t stop you from using it as a valid identity document for Form I-9 purposes.

REAL ID Act and National Security

The REAL ID Act of 2005 was enacted to enhance national security. It requires all states to comply with federal standards when issuing driver’s licenses or identity cards. These standards were set to be in place by October 2020.

This notation simply implies that starting from October 20, 2020, individuals will not be able to use a noncompliant REAL ID driver’s license or identity card to fly within the United States or enter secure federal buildings and military bases that require identification.

Two Types of Driver’s Licenses

To comply with the REAL ID Act, the California Department of Motor Vehicles (DMV) now issues two types of driver’s licenses or identity cards. One type complies with the federal standards, while the other does not. However, both types are equally acceptable for Form I-9 requirements.

Acceptable List B Document

The U.S. Citizenship and Immigration Services acknowledges this issue and states that a state-issued driver’s license with the “FEDERAL LIMITS APPLY” notation (or a similar one) is acceptable as a List B document. This is true as long as the license contains a photograph or identifying information such as name, date of birth, sex, height, color of eyes, and address.

Obtaining a REAL ID Driver’s License

If you wish to obtain a REAL ID driver’s license in California, you must visit a DMV office in person. You will need to present an original or certified document to prove your identity, such as a U.S. passport, a certified copy of a birth certificate, a permanent resident card, or an unexpired foreign passport with a valid U.S. visa and an approved I-94 form.

Additionally, you will need to provide two documents that establish your physical address. Examples of acceptable documents include car registration, home utility bills, phone bills, a mortgage statement or lease agreement, bank records, and insurance documents.

To get a visual representation of the two different types of licenses, you can visit the REAL ID page on the DMV website.

Remember, as an employer, if you accept a driver’s license with a limiting notation as a List B document, you must also examine a List C document to establish the employee’s employment authorization.
