Underage DUI / OVI (OVUAC)
OVUAC stands for Operating a Vehicle after Underage Consumption. This is typically the charge when a person under 21 has a blood alcohol concentration (BAC) of between 0.02 and 0.08. If the BAC is above 0.08, the person will be charged with DUI / OVI “per se.” Often, the person is also charged with DUI / OVI “impaired.” Along with the DUI / OVI , an administrative license suspension may be imposed. Whether the person is charged in adult or juvenile court depends upon the age of the driver.

Ohio law makes very little distinction between DUI / OVI and OVUAC. Pursuant to ORC 4511.19(B), no person under 21 shall operate any motor vehicle if, at the time of operation, any of the following apply:
- The juvenile has a concentration of at 0.02 of one per cent but less than 0.08 of one per cent by weight per unit volume of alcohol in the person’s whole blood.
- The person has a concentration of at least 0.03 of one per cent but less than 0.096 of one per cent by weight per unit volume of alcohol in the person’s blood serum or plasma.
- The person has a concentration of at least two-hundredths of one gram but less than eight-hundredths of one gram by weight of alcohol per two hundred ten liters of the person’s breath.
- The person has a concentration of at least twenty-eight one-thousandths of one gram but less than eleven-hundredths of one gram by weight of alcohol per one hundred milliliters of the person’s urine.

Put simply, if a person under the age of 21 is pulled over and has a BAC of 0.02 or more, they will be charged with OVUAC. Although the alcohol limit is different for young people, the DUI/OVI investigation is essentially the same. Police will observe the young person, administer field sobriety tests, and if enough clues are observed, the police officer will arrest the young person and administer a blood, breath or urine test.
Penalties for Underage DUI / OVI (UVUAC)
If the young person exceeds the limit of 0.02, but is less than 0.08, the person will ordinarily be charged with OVUAC. If the result is over 0.08, the person under age 21 will be charged with DUI / OVI “per se” and, most likely, DUI / OVI “impaired.”
If the person is convicted of OVUAC in adult court, the penalty is a misdemeanor, which includes a maximum 30 days in jail and $250 fine. If the person is convicted in juvenile court (which is called an adjudication), the sentence may include a fine, probation, license suspension of up to 2 years, alcohol or drug treatment, and a driver’s intervention program.

In addition to the penalties above, a person convicted of UVUAC must wait 60 days before driving privileges will be granted, re-take the driver’s license test and provide proof of insurance to the Ohio BMV. Moreover, a conviction for UVUAC can enhance a later conviction for DUI / OVI .
