What Is Municipal Law

Municipal laws often seem simple on the surface, but they can present some pretty complex situations when they are put into practice. For example, while the laws and bylaws of a single city or county may be easy to follow, how those laws coexist with state and federal regulations can result in confusion or conflicts.

What Is Municipal Law?

Municipal law is a local form of legislation. It can exist at the city or county level and while it cannot supersede state or federal law, it does give the municipality the control to set its own bylaws, elect its own government, and make reasonable addendums to existing state and federal regulations.

California Municipal Law Issues

In November 2016, Proposition 64 passed in the state of California, allowing the use of recreational Cannabis. However, some municipalities passed pre-emptive emergency ordinances prohibiting the cultivation and/or sale of marijuana.
