Regarding this issue, LawNet would like to answer as follows:

1. Criteria to be awarded the Prime Minister’s Certificate of Merit in Vietnam

According to Article 38 of Decree 91/2017/ND-CP, the criteria for being awarded the Certificate of Merit by the Prime Minister are as follows:

– “The Prime Minister’s Certificate of Merit” to be awarded to exemplary individuals who well abide by the guidelines of the Party, policies, and laws of the state and who meet one of the following criteria:

+ Having outstanding and typical achievements that are commented on in emulation movements launched by the Central Emulation and Commendation Council or the central ministries, branches, provinces, or mass organizations when preliminary and summarizing 3 years or more;

+ Having made many achievements or unexpected achievements with influence in ministries, departments, branches, provinces, and central mass organizations;

+ Having been awarded certificates of merit at the ministerial, departmental, branch, provincial, or central mass organization level, and for the next 5 years or more, have continuously successfully completed tasks. During that time, there were 05 initiatives that were recognized and effectively applied at the grassroots level, were clever, brave, creative, or served in combat; during that time, there were 05 or more certificates of merit awarded.

– The “Prime Minister’s Certificate of Merit” is awarded to exemplary workers, farmers, and workers who well abide by the guidelines of the Party, policies, and laws of the state and who meet one of the following criteria:

+ Having made many achievements or unexpected achievements in labor and production with influence in the district-level area;

+ Workers have initiatives that bring high-value benefits, have influence in the district, and contribute to training, fostering, and helping colleagues improve their professional qualifications and skills;

+ Farmers have had effective and stable production models for 02 years or more, helping farmers reduce poverty and create jobs for workers.

– “The Prime Minister’s Certificate of Merit” to present to an exemplary collective of good observance of the Party’s guidelines, policies, and laws of the State, internal solidarity, meeting one of the following criteria:

+ Having outstanding and typical achievements that are commented on in emulation movements launched by the Central Emulation and Commendation Council or by ministries, departments, branches, provinces, or central mass organizations when preliminarily, summarizing 03 years or more;

+ Establishing extraordinary achievements with influence in ministries, departments, branches, provinces, and central mass organizations;

+ Having been awarded the Certificate of Merit at the ministerial, departmental, branch, provincial, or central mass organization level and for the next 5 years or more for continuously successfully completing tasks, during that time, he/she was awarded the Emulation Flag at the ministerial, departmental, branch, provincial, or central mass organization level once or was awarded the Certificate of Merit at the ministerial, departmental, branch, provincial, or central mass organization level twice.

– “The Prime Minister’s Certificate of Merit” to present to the exemplary family who well abided by the Party’s guidelines, policies, and laws of the State, making great contributions to labor and land and property for the locality and society.

2. Application for consideration and award of the Prime Minister’s Certificate of Merit in Vietnam

Specifically, in Article 57 of Decree 91/2017/ND-CP, the Prime Minister’s application for a Certificate of Merit is as follows:

– Application for the “Prime Minister’s Certificate of Merit” includes 02 sets (originals), including:

+ Reports of ministries, departments, branches, provinces, and central mass organizations;

+ Report on achievements of cases of commendation and commendation with certification of the level submitted to the Prime Minister;

+ Minutes of the meeting to consider and reward the Emulation and Commendation Council of ministries, departments, branches, provinces, and central mass organizations.

– The dossier of the Central Committee for Emulation – Commendation to Submit to the Prime Minister consists of 01 set (original), including: The report of the Central Committee for Emulation – Commendation to Submit to the Prime Minister (enclosed with the list) and relevant documents specified in Clause 1, Article of Decree 91/2017/ND-CP.
